The Biden case resolution (as well as the Clinton case resolution, by the way) blows up both 1 and 2. Charging Trump, but not them, is obvious selective and corrupt prosecution, which annihilates the case. Further, their examples would lead a reasonable man to conclude that it would not be considered a criminal prosecutable act for a high-ranking official to possess such documents. Ergo, there is no way to prove either knowledge aforethought or intent. Case closed.

All that aside, it wasn’t a crime for Trump to have his personal records — and these were his personal records — at his home because presidents (unlike Biden and Clinton, by the way) have a right to do so. Thus, even if he did have docs with “classified markings” or “pertaining to national defense”, it’s a moot point because he’s allowed to have them. No crime. Case closed.
